1. General Info & Produce Availability
Business Details: Gummers of King Street is located at King Street, Belper, Derbyshire.
Nature of Produce: Because our stock arrives fresh daily from the wholesale market, items may vary based on seasonal availability and market conditions. Box contents (Fruit, Veg, Salad, Herbs) may vary from the images shown on the website.
Orders: Minimum order value and delivery charges will be displayed clearly at checkout.
2. Subscription Services
By signing up for a regular seasonal box subscription, you agree to the following:
- Recurring Billing: You authorise us to take recurring automated payments at the frequency you selected (e.g., weekly, fortnightly) using your chosen payment method.
- Price Adjustments: We reserve the right to adjust subscription prices with reasonable advance notice.
- Cancellation & Pausing: You can pause or cancel your subscription at any time via your account dashboard. To avoid being charged for your next delivery, cancellations or changes must be submitted at least 72 hours before the expected delivery.
3. Delivery
We deliver up to a specified radius from our shop in Belper.
Please ensure your delivery address falls within our delivery area before ordering.
You are responsible for ensuring that a safe place to leave the produce is designated if you are not home. As our goods are perishable, we cannot accept liability for items that spoil or go missing after they have been successfully delivered to your doorstep or designated safe place.
4. Refer a Friend Scheme
- Eligibility: To participate, you must be an active customer with an account.
- Fair Use: Referrals must be genuine friends, family, or acquaintances. Self-referrals (e.g., creating multiple accounts with different email addresses for the same household) are strictly forbidden.
- Rewards: Referral rewards, discounts, or account credits will be applied only after the referred friend places their first qualifying order. Rewards are non-transferable and have no cash alternative value.
- We reserve the right to modify, suspend, or cancel the Refer a Friend scheme at any time if fraud or abuse is suspected.
5. Cancellations, Returns, and Refunds
- Perishable Goods: Under the UK Consumer Rights Act, perishable items (like fresh fruit, vegetables, and eggs) are exempt from the standard 14-day “cooling-off” cancellation period.
- Quality Issues: If any item arrives damaged or sub-standard, please contact us within 24 hours of delivery with photographic evidence. We will gladly issue a replacement or a partial refund/credit to your account for the affected items.
6. Limitation of Liability
To the fullest extent permitted by law, Gummers of King Street shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or the consumption of our products.
7. Governing Law
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
